Based on approved by Congress and ratified by the Presidency based on the provisions of item (I) of article (16) and item (iii) of article 73 of the Constitution.
Issued the following law:
No. () for the year 2009
Law on the reconstruction of infrastructure and service sectors.
Article 1 this law is intended to implement strategic projects and services and rebuild infrastructure for critical projects which have an impact on the economic and social life.
Article 1.2. This code applies to contracts concluded by national investment Commission with Iraqi and foreign firms to build the projects specified in the tables annexed to this law.
Article 3-implemented projects covered by the provisions of this law by payment term or direct investment or partnership between the public sector represented by national investment Commission and Iraqi and foreign firms.
Article-4-up amounts of contracts covered by the provisions of this law (70000000000) $ 70 billion.
Article-5-a national investment Commission approved Prime Committee to:
I. technical and economic requirements of each project.
II. determine the cost of speculative project.
III. provide a timetable for the project.
Article 6-payment by the Iraqi Government contracted project value payment term after at least (5) five years from the date of completion of the project or any period agreed to at least (5) five years from the date of completion of its implementation.
Article-7-derogation from the provisions of law on the sale and lease of State funds no. (32) of 1986 regulating the sale of residential units in projects under the provisions of this law and distribution system.
Article 8 applies the investment law No. (13) of 2006 at all unless the text of this law.
Article-9-President of the national investment instructions to facilitate the implementation of the provisions of this law.
Article-10-this law from the date of its publication in the Official Gazette.
Rationale
In order to promote economic and development realities of the Iraqi economy and implementing service projects and reconstruction projects and infrastructure law launched postpaid.
The proposed total cost of projects
The total cost of the investment programme proposed developmental question is estimated at 70 billion dollars, occupied housing 35.7% followed by the agricultural sector by 25.4% and then transport by 11.4%, followed by water and sanitation projects by 8%. Etc as shown in the graph and table:-

The Cabinet agreed to refer the Bill to rebuild infrastructure and service sectors in its twenty-second regular meeting, held on 16/6/2009 and have been checking the law by the Council of State on 11/6/2009 received Commission on economy, investment and reconstruction Bill on 27/6/2009 and have submitted the project for first reading on 5/7/2009 and was the first reading on 7/7/2009 the Commission studied law and was hosted by the President of the national investment Commission to enquire about the details of the projects mentioned in the table Annex.
The delay in reconstruction of infrastructure and lack of basic services as electricity and potable water and repairing damaged facilities and institutions had a direct impact on increasing unemployment and the housing crisis and rising poverty and to accelerate reconstruction projects will help absorb unemployment and create jobs and revitalise the economy and provide services to citizens and provincial reconstruction and development, as is known, the rapid decline of oil prices in late 2008 due to the global financial crisis has had an impact on low income The federal budget deficit by high oil prices, however, began to rise and is expected as studies that prices will remain high and thus initiate contracts for strategic projects and services and rebuild infrastructure in term payments amount to gain time and reimbursement will be granted on the basis that oil prices will rebound continues, what provision is to cover at least the duration of the project after (5) years from the end of the specified project.

2 through articles (2, 3, 5) indicated that national investment Commission has been empowered by the Cabinet in concluding contracts and projects in three ways:
A payment term
B direct investment
C participation between body and Iraqi companies () or foreign and establishment of a follow-up Committee set out in article 5 of law but did not provide any material on this authorization so we propose a new article containing it.
3 article-5-a Committee having specific tasks can be considered follow-up functions but no article of any State be formed may be composed of staff of the authority or of ministries or agencies?
4 the rationale must be selected to suit the size advantage would this law.
