Article 1-the following terms shall mean for the purposes of this Act, the meanings of each:I. the stricken region: region of the Republic of Iraq is a disaster, whether by nature or by man.II. disasters: devastating event resulting from natural or unnatural force leads to damage to physical infrastructure or human to the stricken region.Article 2 – may declare a State of emergency in the following cases:I. If the Iraqi people are in danger of threatening the event and harm as a result of terrorist acts carried out by groups of armed or unarmed.II. If serious disorder in public security or seriously threatened.III. any military or non-military threat to the peaceful transfer of power in accordance with the provisions of the Constitution.IV. If an epidemic or catastrophe.V. Declaration of war or the threat of its declaration or the country or region where hostile military action threatening the safety of Iraq.Article 3-application for declaration of a State of emergency to the Parliament by the President of the Republic and the Prime Minister and the Council for consideration in accordance with the provisions of the Constitution by [7] days from the date of its registration in the Office of House speaker.Article 4-first: sends the House resolution to approve the Declaration of a State of emergency to the President of the Republic and the President of the Council of Ministers [24] hours from the date of its promulgation.Second: the President of the Council of Ministers issued a statement declaring a State of emergency and declare the following:I. why you called.II. determine the area covered.III. date of entry into force.Article 5-a State of emergency may be extended in accordance with the mechanism provided for in articles [3] and [4] of the Act.Article 6 – ending the emergency order issued by the President of the Council of Ministers by the end of the specified period or at the end of the case for which a State of emergency was declared.Article 7 – displays the Prime the House action and consequences during a State of emergency during the [15] days from the date of its completion.Article 8-1 of the President of the Council of Ministers to exercise in the region or regions covered by the Declaration of a State of emergency and do not interfere with the Constitution the following powers:1. restrictions on the freedom of persons to move traffic and curfew in certain places or at certain times.2. order the arrest of persons suspected of criminal conduct or dangerous to public order.3 – house arrest persons dangerous to public order in their homes or in any city of their choice.4. order the search of persons and premises, whatever that identifies it for people and place appropriate search.5-prohibition of entry in some places absolutely or limited by condition or with permission.6. restrictions on the freedom of persons and disperse meetings and rallies by force if it feared breaches of public security may use the firearm in accordance with the law.7. some entities or travel ban alsha, or where and when an epidemic or public disaster or when a rebellion or insurrection or the possibility of having.8. the imposition of a curfew in the region is a serious threat to security.9. restrictions on travel outside of Iraq or come to it.10 expulsion of aliens of the Republic of Iraq and prevent their entry where when entering them poses a threat to public security.11. censorship of print media such as newspapers, magazines, books, pamphlets, writings, graphics chips, optical and audio before publication or broadcast, seizure, confiscation and preventing the publication or broadcast and closing places printed if its like disturbing public order or morals or terror and spirit differentiation between citizens and undermining the constitutional order in the country.12. the censorship of foreign publications or newspapers and seizure and prevent the circulation in the country for the reasons set forth in item [XI] of this article.13 – monitoring of mail and the Telegraph and all telecommunications and electronic search and seizure.14. control over the circulation of commodities and their prices and grab them if public interest provided compensation to the owners fair compensation.15. the employment of persons to work on epidemic or disaster with adequate remuneration.16. Select the dates of opening and closing shops and order the closure of all or part of these shops whenever public Security Bureau.17. Declaration of disaster area due to natural or human disaster, a statement published in the Official Gazette.Second: the Prime Minister guide the efforts of State institutions to avoid the effects of the disaster or epidemics in the affected areas and provide humanitarian aid to counter the effects of the disaster and the affected area is given the highest priority in the application for assistance and widgets that set to avoid the effects of the disaster and has requested aid from the States and organizations concerned to assist in the relief and assistance in the event of the inability of the State to counter the effects of the disaster.Article 9 – without prejudice to any harsher penalty prescribed by law shall be punished with imprisonment not exceeding three years and/or a fine of not less than 2 million dinars, or one of those penalties any person who contravenes the orders or communications or statements or decisions made by the Prime Minister during the emergency period.Article 10 – is an aggravating circumstance of crimes during the emergency period.Article 11 – delivers them according to the provisions of this law to the police station and the police officer to take legal action in them.Article 12 – 1 may appeal decisions issued in accordance with the provisions of this law, to the Court or administrative justice and consider urgently in accordance with the law.Second exception to clause [first] of this article may appeal decisions of the arrest on the basis of the provisions of this law to the Central Criminal Court as discriminatory under the law.Article 13 – first: the Central Criminal Court the criminal offences committed during the duration of the emergency.Secondly: the criminal courts both by jurisdiction offences not provided for in Regulation [first] of this article.Article 14 – eliminates:First: the national safety code number [4], 1965.Secondly: is defending national safety number [1] of 2004.Article 15 – this law shall from the date of its publication in the Official Gazette.Rationale:In order to meet the conditions and disasters and epidemics that may be exposed to the Republic of Iraq, which may affect the safety of the homeland and the citizen in order to avoid the serious consequences of these circumstances and for the use by a State of its various voltage, exceptionally urgent and initiated the Act. ..
