Baghdad/Obelisk: put the House of representatives, Thursday, a bill ratifying the Convention between the Government of the Republic of Iraq and the State of Kuwait concerning the regulation of shipping in the Khawr Abd Allah in front of deputies in a first reading, amid expectations that its debate on the law with members of the State province continued to protest against the law not to include a draft law outlawing the Baath party.



A parliamentary source said "the Obelisk", "the agenda of the Parliament session that was distributed today includes the first reading of the draft law on the ratification of the Convention between the Government of the Republic of Iraq and the Government of the State of Kuwait concerning the regulation of shipping in the Khawr Abd Allah", stating that "the Bill sent by the Government of Iraq to be submitted to Parliament foreign relations committees in Parliament and legal Committee combined and contains two articles.



The source pointed out that the draft law provides that the Cabinet's approval of the agreement came "out of the Government to strengthen the bilateral relationship between the two countries, and respect the rights of maritime traffic adopted in international covenants and conventions and to support the shipping industry through the regulation of maritime traffic in the Khawr Abd Allah through the formation of a joint Commission working to operationalize and implement the terms of this agreement and the development of joint plans for maritime safety in the Khawr Abd Allah and other navigational and environmental issues".



He also pointed out that the Convention provided for not raising any flag for ships carrying the nationality of one of the Contracting Parties is not aware of its nationality by passing through the territorial waters of the other party in the exercise of the right of passage navigation.



Either foreign vessels they will raise the flag of nationality only. The provisions of this Convention shall not apply to the passage of warships and Coast Guard for both parties where each party will work to prevent fishermen from being in part in its territorial sea from the fairway. The parties also cooperate to preserve the marine environment from pollution risks whatsoever and work to combat and eliminate its effects.



According to the draft Convention, the fairway is mentioned in the Convention is the fairway from the confluence of the navigation channel in the Khawr Abdullah to the international border between the two border (156) and (157) southwards to the point (162) and then to the beginning of the portal navigation channel at the mouth of the Khawr Abdullah.



Also draws that the parties to the Convention will be a joint management committee, chaired by the Undersecretary of the Iraqi side and the Ministry of communications on the Kuwaiti side and an equal number of specialists from both sides, so the Committee will organize and coordinate the tasks of navigation on the fairway in the Creek and develop a joint plan to ensure the safety of navigation in the fairway and approve maintenance work as expansion and deepening and developing guidelines and hydrographic surveys and alguark. These costs shall be shared equally between the parties to the Convention.



The Iraqi Government approved on 30 January an agreement with Kuwait concerning the regulation of navigation on the Khawr Abd Allah, overlooking the Gulf, after a long political controversy between the two countries for more than two years.



He said the relationship between the Secretary-General of the Council of Ministers at a joint press conference on 30 January with Deputy Prime Minister Hussein Shahristani, that the most important decisions of the Council of Ministers approved the agreement between Baghdad and Kuwait to regulate navigation on the Khawr Abd Allah that initially signed earlier.



The Iraqi Government is of the opinion that the Convention is very important for the regulation of shipping in the port of Khawr Abd Allah in terms of traffic and environmental safety and all aspects to ensure smooth navigation on this channel.



Kuwait has embarked on building a port on the Gulf which sees Iraqis that would hamper navigation in a large part of their territorial waters on the Gulf, has led to political controversy between the two countries.



The Foreign Ministry called on 7th January the Cabinet approval of the draft law, and supported the legal service in the General Secretariat of the Council of Ministers on 14 January the Council presentation.



The Convention based on the United Nations Convention on the law of the sea of 1982 and the commitment to United Nations Security Council resolution (833) of the international boundary between the two countries, particularly with regard to respect for the right of navigation for both parties.



It is hoped that the Convention will enter into force after the approval in Parliament of the implementation date of the exchange of diplomatic notes the Pro terminal authentication official Convention and diplomatic means in accordance with the established constitutional procedures in both countries and the Convention will remain in effect for an indefinite period unless one of the parties to terminate and notify the other party before six months that that is terminated with the consent of the Contracting Parties.
